Most BC employees are protected by the BC Employment Standards Act, which sets minimum standards employers must follow regardless of what's in an employee’s contract.

Key rights include: minimum wage, a written employment contract or terms of pay, a pay stub with each payment, statutory holidays and vacation pay (2 weeks after 1 year, 3 weeks after 5 years), rest breaks and limits on hours of work, protection from unpaid overtime, job-protected leaves (parental, sick, bereavement, and others), and notice or pay when your job ends.

BC workers are also protected from discrimination under the BC Human Rights Code, and from unsafe workplaces under WorkSafeBC rules. Some workers - such as federal employees, professionals or independent contractors - are outside ESA coverage.

Can my employer fire me without cause in BC?

How much notice or severance pay should I get in BC?

The length of notice or pay depends on how long you’ve worked for the employer. There are two layers of notice entitlement and severance pay in BC:

ESA minimum: The minimum notice/pay requirement is based on length of service. Under the Act, you’re entitled to between 1 and 8 weeks of notice depending on your years of service.
Common law: This standard refers to the common legal practice, compared to the ESA minimum. It is the amount a court is more likely to award, if there is a court case regarding termination compensation. Courts consider “reasonable notice” (or pay) to be about 1 month for each year of service.

Your exact entitlement may vary, so legal advice is recommended. In some cases, if you’re fired for misconduct, the employer may not owe you notice or pay.

What is the minimum wage in British Columbia?

The minimum wage in B.C. is currently $18.25 per hour (as of June 1, 2026).

This rate applies to most workers, regardless of whether they are paid hourly, salary, or commission. There are some exceptions, such as live-in home support workers or farm workers, who may have different rules.

Am I entitled to overtime pay in BC?

Most employees covered by the BC Employment Standards Act (ESA) are entitled to overtime pay. There are exemptions for certain professions (e.g., some managers, IT professionals in certain roles, and other exempt categories). If you're covered, standard overtime rules are:

1.5x your regular wage for hours worked over 8 hours in a day or 40 hours in a week
2x your regular wage for hours worked over 12 hours in a day

Some workplaces have an averaging agreement in place (approved in advance) that changes how overtime is calculated over a set period — check your contract or ask your employer if one applies to you. Overtime must be paid in wages unless you and your employer agree in writing to "time off in lieu" at the appropriate premium rate, taken within a set time frame.

What can I do if I’m not paid by my employer in BC?

If your employer hasn't paid wages, overtime, vacation pay, or other amounts owed under the Employment Standards Act (ESA), you have a few options:

Talk to your employer first (if safe to do so) — sometimes it's a payroll error that gets fixed quickly. It may be helpful to have a written request and their response in writing.
Use the ESA Self-Help Kit — the Employment Standards Branch requires most people to try this step before filing a formal complaint. It walks you through calculating what's owed and writing a formal request to your employer.
File a complaint with the Employment Standards Branch if the self-help step doesn't resolve things. An officer can investigate, order your employer to pay, and issue a Determination (an enforceable decision).

Important things to know:

Final wages are due within 48 hours of an employer ending your job, or within 6 days if you quit.
There's a strict 6-month time limit to file a complaint from when wages were due, so don't wait too long.
Complaints can be made anonymously in some circumstances, and it's illegal for an employer to retaliate against you for asserting your ESA rights.

Does employment law apply to contractors in BC?

Independent contractors are not covered by the Employment Standards Act, but they do have rights under contract law. Sometimes, workers are misclassified as contractors when they are really employees. .

Generally, no — the ESA applies to "employees," not to genuine independent contractors. Contractors are usually covered by their contract terms and general commercial/contract law, not employment standards like minimum wage, overtime, vacation pay, or termination notice.

However, this distinction between an employee and a contractor may be disputed. Simply being labelled a "contractor" in your agreement doesn't automatically make you one in the eyes of the law. Courts and the Employment Standards Branch look at the real nature of the relationship, including:

How much control the employer has over how/when/where you work
Whether you use your own tools/equipment
Whether you can subcontract the work or send someone else
Whether you bear financial risk or opportunity for profit
How integrated you are into the business

If these factors point to an employment relationship despite being labeled a "contractor", you may actually be a "dependent contractor" or employee, and entitled to ESA protections (and possibly common law notice). What are my rights if I’m harassed at work in BC?

Workplace harassment and bullying are not tolerated in BC. Your rights, protections and complaint procedures depend on the type of harassment: Discriminatory harassment (based on a protected ground like sex, race, disability, religion, sexual orientation, age, etc.) is prohibited under the BC Human Rights Code. You can file a complaint with the BC Human Rights Tribunal, generally within 1 year of the last incident.

Bullying and harassment (not tied to a protected ground) is addressed through WorkSafeBC occupational health and safety requirements. Employers are legally required to have a workplace bullying and harassment policy, a reporting investigation process, and to take reasonable steps to prevent and respond to harassment. You can file a complaint with WorkSafeBC if your employer fails to meet these obligations. Practical steps:

Document incidents in writing (dates, details, witnesses).
Report internally following your employer's policy, if you feel safe doing so.
If unresolved, file a complaint with the BC Human Rights Tribunal (for discrimination-based harassment) or WorkSafeBC (for general workplace bullying/harassment).
If harassment leads to a hostile environment forcing you to quit, you may have a claim for constructive dismissal.

If the problem is unresolved, complete and submit the ESB Complaint Form online, by mail, or in person to the Employment Standards Branch, along with supporting documents (pay stubs, employment contract, records of hours, correspondence).
An Employment Standards Officer will review your complaint — this may involve mediation, investigation, and ultimately a formal Determination (enforceable decision) against your employer.

Key deadlines:

Complaints generally must be filed within 6 months of the issue.
Keep records/evidence, since ESB relies heavily on documentation.
