Does the Residential Tenancy Act apply to my situation?
Not all rental arrangements in BC are covered by the Residential Tenancy Act (RTA) and the Residential Tenancy Branch (RTB). It's important to understand if your tenancy qualifies.
The RTA generally does not apply if you:
- Rent a room in a home where the landlord also lives and you share a bathroom or kitchen with them (shared accommodation)
- Live in a hotel, motel, or similar transient accommodation
- Live in certain types of co-operative housing
- Rent under a license rather than a tenancy agreement (e.g. some caretaker or employment arrangements)
- Live in accommodation tied to your employment
If you're unsure whether the RTA applies to you, the Residential Tenancy Branch can help you assess your situation.
If your tenancy is not covered by the RTA, your rights will depend on your rental agreement and general contract law. It's advisable to get legal advice about your specific circumstances.
